General TERMS AND CONDITIONS

DEFINITIONS. In the Agreement, "Club Owner" means an independent franchisee. "Club" means the club at which the Agreement is signed. "I" and "Member" means the person whose name and signature appear on the Agreement. "Licensor" means the brand owner. Members are responsible for updating address and contact information.


COOLING OFF PERIOD. If Members wish to cancel their Agreement, Members may cancel by delivering or emailing a written notice to the Club. The notice must say that the Member does not wish to be bound by the Agreement and must be delivered or emailed before midnight on the second business day from the Agreement date. The notice must be delivered or emailed to the club address. If the Member cancels, the Club will return, within 10 business days of the date on which the Member gave notice of cancellation, any payments the Member has made. All refunds will be by direct deposit into a nominated account; there are no cash refunds.


MEMBER OBLIGATIONS. The Agreement is a legally binding obligation for which the Member is financially responsible. If the Member has a prepaid membership, the Member acknowledges that the fee paid is not refundable under any circumstances. If the Member has a term membership, the Member's membership will automatically renew after the term ends and the Member will continue to be billed according to the Member's regular billing schedule unless the Member provides notice of cancellation. A term membership has an early cancellation fee of £75.00. The Member agrees not to conduct any kind of commercial or business activity in the Club and will not act as a personal trainer for anyone within the Club. The Member understands that the Member is responsible for updating their address and contact information.


CANCELLATION. After the Member's right to cancel period noted earlier (if any), the Member may cancel membership by filling out a cancellation form at the Club. The Member understands they may be billed for up to 30 days after the Member cancels membership and will have access to the Club during that time. If the Member dies or becomes totally or permanently disabled, upon reasonable written notice to the Club with proof of the death or disability, either the Member or their estate may cancel the Agreement and receive a prorated refund of the unused portion of membership fees incurred.


RECIPROCITY AND TRANSFER. Membership to the Club allows Members to access other Snap Fitness® locations free of charge. Members use of all Snap Fitness® locations is subject to the terms of their Agreement and the Member has the same obligations to any Snap Fitness® location as the Member has to the Club and Club Owner, including the assumption of risk and waiver of claims. The Member understands that if they use another Snap Fitness® location more than the Club, membership will be transferred to that location according to the then-current membership transfer policy. If membership is transferred, the Member agrees that the Agreement will automatically be transferred to and enforceable by the new home club and membership dues will be the price of the new home club.


MEMBERSHIP FREEZE. Members have the right to freeze memberships for up to three months per year, during which time they will not be charged standard membership dues. Members must provide written notice at least five days in advance of their next billing cycle. Members will incur a processing charge of £3 for each frozen month. For prepaid or term agreements, the membership will be extended for a period equal to the freeze period. A membership cannot be cancelled during a freeze period.


MONEY BACK GUARANTEE. If Members do not feel a positive difference in their physical wellbeing within 30 days of signing the Agreement, the Club will give their money back (membership dues and access card monies). Members must do the following two things – (1) work out at the Club twice per week for four weeks AND (2) attend a fitness evaluation with Club staff. To request a refund, Members must personally deliver a written notice to the Club on or before the 30th day of my membership including a statement of why they are requesting a refund. The refund does not apply to program fees, personal training, vending or merchandise purchases.


FACILITIES AND SERVICES. The Club reserves the right at any time to delete, discontinue, repair or replace the facility equipment without any effect on the Agreement. The Club may be closed for up to two weeks each year for maintenance purposes.


MINIMUM AGE. All membership holders of the Club must be a minimum 14 years of age. The minimum age may vary from club to club at the Club Owner's discretion but never below the minimum age requirement. All minors under the age of 18 are restricted to access during staffed hours only, and a parent or legal guardian must sign the membership agreement.


NO STEROIDS. Snap Fitness bans the use of steroids and Members agree not to use, sell or exchange steroids on the Club’s premises.


LIMITATION OF LIABILITY. Members agree that, except for any legal responsibility that Club Owner or Licensor cannot exclude in law (such as for death or personal injury), Club Owner and Licensor are not legally responsible for any: (i) losses that (a) were not foreseeable to the Member and them when the contract was formed or (b) were not caused by any breach on the part of Club Owner or Licensor ; (ii) business losses; or (iii) losses to non-consumers.


MISCELLANEOUS. This is the whole Agreement between the parties with respect to the Membership Terms and Conditions and supersedes any prior understandings or agreements of the parties whether written or oral, express or implied. The Agreement may not be amended or modified except in a writing signed by both parties. Members understand that only authorised members or guests may access the Club and Members are not permitted to share their access cards with anyone else.
